DigiPhyte (Pty) Ltd, operating as Business in a Day, is the responsible party (and operator) for personal information collected through this site and during service delivery.
To deliver the BiaD service: build your site, set up your email, register your domain, and communicate with you about your project. We also use aggregated analytics to improve the service.
We share the minimum data necessary with: our hosting provider, our email provider, our payment gateway, and our analytics tool. Each of these has its own privacy terms. We do not sell or rent your data to anyone.
How long we keep your data depends on why we have it. Enquiries from our forms (the audit, checklist, waitlist, and booking forms) are kept only as long as we need to deal with your request, then deleted, unless you become a client. For clients, we retain account and billing records for the duration of your account plus seven years thereafter, as tax and company law require. Call recordings are deleted within 90 days of project completion unless you ask us to keep them. You can ask us to delete your information or withdraw your consent at any time, subject to records we are legally required to keep.

Business in a Day delivers, depending on your tier, a brand identity, a live website on a domain you own (the first year of the domain included), business email, social profiles set up, a strategy document, an AI starter kit, AI-visibility setup (Schema.org and similar), one included industry module, and ongoing hosting and security. The exact deliverables for your tier are listed on the What you get section.
Setup is a single once-off amount, paid up front to confirm your booking and protected by our money-back guarantee. There is no deposit and no 50/50 split. We currently accept payment by EFT; card and debit-order options may be added in future. If you need a bespoke payment arrangement, ask us and we will document it individually.
Ongoing hosting is separate from setup. After your first free month, the Live plan (currently R250/month for hosting, inclusive of VAT, plus Google Workspace: a managed mailbox from about €7 per mailbox a month, or R30 a month to bring your own email) is payable monthly in advance and is required to keep your site online. Missed payments may suspend the service after a 7-day grace period.
All prices displayed on this site are inclusive of 15% value-added tax. DigiPhyte (Pty) Ltd is a VAT-registered vendor under the Value-Added Tax Act, 89 of 1991 (VAT registration number 4910320821). A compliant tax invoice is issued for every payment, showing the VAT-exclusive amount, the VAT charged, and the VAT-inclusive total separately.
Pro tier: we aim to complete your build within one business day of your recorded interview. This is a target, not a guarantee. Delays in your feedback or sign-off, or significant changes of direction after the interview, may extend the timeline. Designer tier: as agreed during your interview, typically 7 to 14 business days. During any introductory or promotional pricing period, delivery timelines are best-effort.
The Electronic Communications and Transactions Act, 2002 (section 44) gives a seven-day cooling-off right on certain distance-sold electronic transactions. Our service works a little differently: what we build is created specifically for you, and we only begin once you ask us to. Before we begin building, you may cancel for a full refund, for any reason. By booking and attending your interview, you are asking us to begin a personalised service straight away; once we have begun, your protection is our money-back guarantee (see Refunds) rather than an automatic cancellation, to the extent the law allows. Nothing in this clause removes any right you have that cannot be excluded by law.
BiaD's liability for any claim is limited to the amount paid for the service. We do not accept liability for indirect, consequential, or special damages. Nothing in these terms limits any liability that cannot be limited by law, including liability for fraud or gross negligence, or any of your rights under the Consumer Protection Act that cannot be excluded.
The Founder's Checklist and the free website audit cost nothing, so there is nothing to refund.
We offer a money-back guarantee and we mean it. The mechanic is revisions-first: if you're not happy, we fix it; if we genuinely cannot fix it, you get your money back, less any third-party costs already paid on your behalf (see below).
You can cancel any time. Cancellation takes effect at the end of the current billing period. We do not refund partial months.
Once you have paid in full, you own all business-specific outputs:
DigiPhyte retains its build system, base templates, prompt library, and pipeline. These are never transferred. Your business outputs are derived from these but the underlying systems remain ours.
Some features are not static files. An industry module (for example a jobs board, a booking system, or a menu manager) runs on infrastructure and services that DigiPhyte operates on your behalf, such as application hosting and a managed database. You own your content and the static pages of your site, and we can hand over the underlying page markup. The module's live functionality, however, depends on our hosted services and pipeline and cannot be exported or transferred as a standalone product. If you leave, your site and content go with you; the live module feature stops, because it is delivered as part of your ongoing managed service.
Ownership transfers on full payment. Until then, DigiPhyte hosts and controls technical access. You retain editorial control of your content from day one.
You may not commercially resell the brand kit, site theme files, or AI starter kit as a product. Personal and business use: unlimited. Resale to third parties as a derivative product: not permitted.
Preview sites at yourname.businessinaday.co.za are not transferred. They are watermarked, non-editable, auto-expire after 30 days, and remain DigiPhyte's property. Upgrade to Pro to convert your preview into a permanent owned asset.
